Please read these Terms of Service ("Terms") carefully before using the Are You Dead? mobile application ("App") operated by Are You Dead? ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Are You Dead? is a safety check-in application that allows users to:

• Set regular check-in intervals (1-7 days)
• Designate emergency contacts
• Receive reminders to check in
• Automatically alert emergency contacts if a check-in is missed

3. Important Disclaimers

THIS APP IS NOT A MEDICAL DEVICE OR EMERGENCY SERVICE.

• The App is NOT a substitute for emergency services (911 or equivalent)
• The App is NOT a medical device and should not be used for medical monitoring
• The App does NOT guarantee delivery of alerts
• Alert delivery depends on network connectivity, third-party services, and other factors outside our control
• We are NOT responsible for any harm resulting from missed or delayed alerts

In case of emergency, always contact emergency services directly.

4. User Responsibilities

You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials secure
• Obtain consent from individuals before adding them as emergency contacts
• Inform your emergency contacts that they may receive alerts from the App
• Not use the App for any unlawful purpose
• Not attempt to interfere with the proper functioning of the App

5. Account Registration

To use the App, you must:

• Be at least 13 years of age
• Create an account with a valid email address
• Provide accurate information

You are responsible for all activity that occurs under your account.

6. Payment and Refunds

The App is a paid application available for a one-time purchase. All payments are processed through the Apple App Store or Google Play Store. Refund requests should be directed to the respective app store according to their refund policies.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Are You Dead? and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP

9. Indemnification

You agree to indemnify and hold harmless Are You Dead? and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
